I don’t think they deserve it. I’ve read a lot of the case and articles from various major media outlets about it. Heck, it’s now come out that Hogan is probably a surrogate for someone else who has an axe to grind against Gawker. Even if that connection isn’t what it seems, Hogan is only trying to cover up all his bullshit to protect his “brand”. It’ll get appealed until it has no where else to go. This is far from over.

I would say yes and no. Sure it’s completely legal for 3rd party funding.

As ugly as details are, this has to be the shadiest and shakiest judgment against 1st Amendment rights ever. Gawker has the legal right to continue fighting this and should. A change of venue would be best. Thiel is doing this for ulterior motives and both Forbes and the New York Times question it. Right now he’s just bleeding them dry slowly.

Plus you have this tidbit from the NYT story:

“Questions about the independence of Mr. Bollea, who never mentioned a third-party backer, first emerged when his lawyer removed a claim from his complaint that had the effect of eliminating Gawker’s insurance company from the case. That struck many legal observers as odd, given that most lawyers seeking large payouts want to include claims that are insured against because doing so increases the chances of a settlement."

It might be shitty, but what Gawker did is not illegal or libelous. It’s not just about the sex on the tape, this led to the whole Hogan saying the n-word thing that cost him lots of income. His skeletons got dragged out and he’s crying foul. I have no sympathy for him. Maybe I’m just jaded because I live in St Pete (and Tampa before that), so we’ve been dealing with Hogan, Bubba, their pals, and all their bullshit for so long. He’s a douche and brought this on himself. And he totally knew he was being taped.

I don’t think this is a 1st Amendment issue because even the 1st Amendment has it’s limits. You can’t yell fire in a crowded theater and you can’t distribute a video of a private citizen when they believed they had a certain expectation to privacy and they weren’t committing any crime. Same reason why posting revenge porn is becoming a crime, this video isn’t in the public interest. If it were a video of a congressman having sex with a lobbyist while they discuss bribes for new laws he’s going to try pass, then sure it’s totally protected by the 1st Amendment. This video is of a dude banging another guys wife while that guys films it, the only thing of public interest here is public rubbernecking at this train wreck of a situation and I’m sorry but even celebrities have a right to a certain level of privacy. This video is more in lines of The Fappening, it’s a gross invasion of privacy and Gawker fucked up by picking this hill to die on.

Of course Thiel has ulterior motives, he’s getting revenge for Gawker outing him back in 2007 (again for a company with a blog that claims to be a “champion” of the LGBT community to do that is pretty fucking reprehensible) and it really doesn’t matter what his motives are, he’s doing something that is literally an industry within the legal world. It’s called Lawsuit Finance and there are companies that specialize in floating money for plaintiffs to take defendants to court with the company getting a cut of the judgment at the end.

Sorry, that was not my intent.

I hope you understand that I’m not necessarily disagreeing with the points thst you are making. My intent is to point out things that should be considered and reassesed instead of a counterargument.

I will say this: if thus judgment stands, it sets a very bad precedent for freedom of speech and a free and uncensored internet in the U.S.

Also may I add something to what you said about Gawker deserving it:

1) I’ve only served on a jury for a criminal case. The responsibility of picking jurors is held by both prosecutors and defendants. They both have to agree on who will be on the jury. If its the same on civil cases, then Gawker’s lawyers fucked up by allowing idiots on the jury.

2) AJ Daulerio is a fucking immature moron and I personally blame him for Gawker’s current state for making that stupid quip during the trial about posting videos of kids as young as 4 if it’s newsworthy (or whatever the hell he said). He’s in his 40's and still acts like a frat boy.
